Terms of Use

This End-User License Agreement ("Agreement") is a legal agreement between you ("End-User" or "you") and Fuelito ("Developer," "we," "us," or "our") for the Fuelito mobile application ("Licensed Application").

By downloading, installing, or using the Licensed Application, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the Licensed Application.

1. Acknowledgement

This Agreement is concluded between you and Fuelito only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Fuelito, not Apple or Google, is solely responsible for the Licensed Application and its content.

This Agreement does not provide for usage rules for the Licensed Application that are in conflict with the Apple Media Services Terms and Conditions or Google Play Terms of Service as of the Effective Date.

2. Scope of License

The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded or Android device that you own or control, subject to the following:

  • The license is non-transferable and may not be shared with others
  • You may use the Licensed Application on devices you own or control
  • The Licensed Application may be accessed and used by other accounts associated with you via Family Sharing (iOS) or Family Library (Android) or volume purchasing
  • You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time
  • You may not rent, lease, lend, sell, redistribute, or sublicense the Licensed Application
  • You may not copy (except as expressly permitted by this license), decompile, reverse-engineer, disassemble, modify, or create derivative works of the Licensed Application

3. Maintenance and Support

Fuelito is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this Agreement or as required under applicable law.

You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

4. Warranty

Fuelito is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple or Google, and they will refund the purchase price (if any) for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation whatsoever with respect to the Licensed Application.

Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Fuelito's sole responsibility.

THE LICENSED APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUELITO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

5. Product Claims

You acknowledge that Fuelito, not Apple or Google, is responsible for addressing any claims you or any third party may have relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:

  • Product liability claims
  • Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement
  • Claims arising under consumer protection, privacy, or similar legislation

This Agreement does not limit Fuelito's liability to you beyond what is permitted by applicable law.

6. Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, Fuelito, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

All rights, title, and interest in and to the Licensed Application (excluding user-generated content) are and will remain the exclusive property of Fuelito and its licensors.

7. Legal Compliance

You represent and warrant that:

  • You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
  • You are not listed on any U.S. Government list of prohibited or restricted parties
  • You will comply with all applicable laws and regulations when using the Licensed Application

9. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application. For example:

  • If you use the Licensed Application while connected to a wireless data service, you must not be in violation of your wireless data service agreement
  • The Licensed Application uses Google Maps services, and you must comply with Google's Terms of Service
  • You must comply with your mobile device manufacturer's terms and conditions

10. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries (for iOS users) and Google and its subsidiaries (for Android users) are third-party beneficiaries of this Agreement. Upon your acceptance of the terms and conditions of this Agreement, Apple and Google (as applicable) will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

11. User Conduct

You agree not to:

  • Use the Licensed Application for any illegal purpose or in violation of any local, state, national, or international law
  • Violate or encourage others to violate the rights of third parties, including intellectual property rights
  • Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate
  • Interfere with security-related features of the Licensed Application
  • Interfere with the operation or any user's enjoyment of the Licensed Application
  • Upload, transmit, or distribute any computer viruses, worms, or any software intended to damage or alter a computer system or data
  • Attempt to gain unauthorized access to the Licensed Application, user accounts, or computer systems or networks

12. Subscription Terms

The Licensed Application offers optional paid subscriptions ("Pro" features):

  • Monthly Subscription: $3.99 per month
  • Yearly Subscription: $29.99 per year
  • Lifetime Purchase: $79.99 one-time payment

Payment and Renewal

  • Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play after purchase

Free Trial

We may offer a free trial period for new subscribers. If you cancel before the trial period ends, you will not be charged. If you do not cancel, you will be automatically charged the subscription fee.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds will be provided for the unused portion of any subscription period.

13. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUELITO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Licensed Application
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Licensed Application
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Licensed Application by any third party
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Licensed Application

15. Termination

This Agreement is effective until terminated by you or Fuelito. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms.

Upon termination, you must cease all use of the Licensed Application and delete all copies from your devices.

16. Changes to Terms

Fuelito reserves the right to modify these terms at any time. We will notify you of any material changes by posting the new terms within the Licensed Application or by email. Your continued use of the Licensed Application after such modifications constitutes your acceptance of the updated terms.

17. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Fuelito operates, without regard to its conflict of law provisions.

18. Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

19. Entire Agreement

This Agreement constitutes the entire agreement between you and Fuelito regarding the Licensed Application and supersedes all prior agreements and understandings, whether written or oral, regarding the subject matter herein.
